​GENERAL CONDITIONS OF SALE
 
These General Conditions of Sale (hereinafter "GCS") define the terms and conditions of sale between the company Mon Chou Oy (“Mon Chou”) and the Customer. These conditions apply to the exclusion of all other conditions.
Mon Chou reserves the right to modify in whole or in part and at any time these GCS.
 
  1. PRODUCTS
The products (the “Products”) offered to the Customer are those which appear in the catalog published on the website (the “Website”) or at the shop (the “Shop”) of Mon Chou, always within the limits of available stocks.
Each Product is presented on the Website with a photograph and a description, which are intended to present to the Customer the essential characteristics of the Products before the final order is taken and can in no way engage the responsibility of Mon Chou. Product visuals are provided for information only and are not contractual.
 
  1. ORDER PROCEDURE
Placing an order on the Website involves opening a Customer Account by entering two identifiers: an e-mail address and a password. These identifiers are and must be kept confidential. The right of access by the Customer to the identifiers can be made on simple request to the customer service of Mon Chou, which will respond only by e-mail to the address used when creating the Customer Account.
The Customer undertakes to complete the order form with precision and to fill in the various existing sections (full name, billing and delivery address, method of payment, etc.). He will receive, after payment, an email confirming the details and terms of his order. The order becomes valid only if all the information requested from the Customer is completed.
By clicking on the icon "Checkout", the customer acknowledges having full legal capacity to engage under these GCS. The Website is accessible by the customer 24 hours a day, 7 days a week, except during the period of annual leave and in the event of maintenance operations.
Before paying the order, the Customer must declare to have read and accepted the GCS. Therefore, the validation of the order means unreserved acceptance of these GCS.
For any order modification, the Customer must contact Mon Chou no later than 48 working hours before the desired delivery date. By email contact@monchou.fi or by logging into his/her personal space. No reimbursement can be made.
Mon Chou reserves the right to refuse an order in the event of the Customer failing to fulfill one of its obligations and more generally, or of an order presenting an abnormal or incomplete character for any reason whatsoever. The order is only final after confirmation by Mon Chou. Mon Chou will confirm to the customer the acceptance of his order by email or, where applicable, his refusal within 48 working hours following the entry of the order on the Website.
 
  1. PRICE
The prices indicated are in Euros including all taxes. VAT included is Finnish VAT applicable on the day of the order. If the VAT rate were to be modified, these changes could be reflected in the price of the items without the Customer being informed beforehand. However, the prices cannot be modified once the order has been confirmed.
Prices and costs are liable to vary or fluctuate depending on the prices of raw materials and the market in general. Mon Chou shall always have the possibility to modify its prices.
 
  1. MEANS OF PAYMENT
Payments are made only by credit card CB, VISA, MASTERCARD, or in cash. The validation of payment by credit card is immediate.
To be registered, the order must be paid in full. Unpaid orders cannot be delivered. In addition, Mon Chou authorizes itself to suspend any order or any delivery in the event of a refusal of authorization of payment by the Customer’s financial organization.
 
  1. AVAILABILITY AND GUARANTEE OF PRODUCTS
The Products sold are offered within the limits of available stocks. A product that becomes unavailable will, as soon as possible, be withdrawn from the catalog or indicated as unavailable for a limited time.
However, if it is impossible to provide the requested Products, Mon Chou will contact the Customer by telephone or e-mail as soon as possible in order to agree with him to postpone the delivery pending the replenishment of said Product, when possible, or to replace the Product with another equivalent in quality and price.
Products are mostly handcrafted and are available in limited quantities, especially during the holiday seasons.
Mon Chou guarantees the Customer that the Products are manufactured and packaged according to strict quality rules and stored in accordance with the standards in force in Finland.
However, Mon Chou cannot extend its guarantee on its Products if the Customer has not complied with optimal storage conditions.
 
  1. COLLECTING THE ORDER
The Customer agrees to come and collect his order at the Shop on the agreed day and time. As the Products are perishable, Mon Chou cannot keep an order that has been forgotten by the Customer. Any forgotten order cannot be refunded under any circumstances.
The Customer must present the necessary supporting documents for the withdrawal of his order: identity document and confirmation email. These supporting documents must correspond to the delivery or billing details entered during the order as well as, where applicable, to the contact details of the holder of the payment card used.
Any order made the previous day before 3 p.m. can be collected at the Shop 48h later at 10 a.m. at the earliest (or 7.30 a.m at the earliest for croissants).
 
  1. TRANSFER OF OWNERSHIP AND TRANSFER OF RISK
Mon Chou insures the Products up to the place of delivery. The risk of transport is borne by the Customer. The recipient must check the shipments upon arrival and to express reserves, or even refuse the package if it is likely to have been opened or deteriorated.
If the Product, under the responsibility of the courier, has not been delivered, due to an event of force majeure as defined by the courts, the sale may then be resolved. and the Customer may obtain a refund of the price to the exclusion of any other compensation or damages.
 
  1. COMPLAINTS
Complaints will always be received with attentive benevolence, good faith being always presumed in those who take the trouble to expose the dispute.
The Customer is required to ensure the conformity of his order at the time of its withdrawal at the Shop. Once the Product has been delivered, no complaint of non-compliance will be accepted. In the case of a delivery, the Customer is required to ensure the conformity of his order. If the Product delivered turns out to be non-compliant, an email must be sent to customer service within 2 hours with a photo of the point of dispute raised.

After analysis, Mon Chou shall decide on a discretionary basis whether a commercial gesture, credit or refund can be offered to the Customer.
 
  1. INTELLECTUAL PROPERTY
The structure, the layout, the graphics, texts, the databases, images, photographs, sounds, videos and other material from the Website are and remain the intellectual property and proprietary company Mon Chou or its licensor and are protected by copyright. The brands, trade names and logos appearing on the Website are registered trademarks unless otherwise stated.
The reproduction, redistribution or use for any purpose whatsoever, even partially, of the elements of the Website are subject to the express prior authorization of Mon Chou. The user who has a website and who wishes to place on his website a link directing to the Website must first seek the authorization of Mon Chou.

The Customer shall not in any case resell the Products. Those are intended for his personal use or that of the recipient of his order. Any total or partial reproduction, modification or use of the Products or their images for any reason whatsoever are strictly prohibited.
 
  1. PROTECTION OF PERSONAL DATA
By ordering via the Website, the Customer consents to the use by Mon Chou of his personal data. These data are necessary to ensure the proper processing of orders. All of the information will be treated with the utmost rigor and the greatest discretion.
Mon Chou undertakes not to disclose to third parties the information communicated by the Customer on the Website. These are confidential and will only be used to process the order and to strengthen and personalize communication, in particular by sending the Mon Chou newsletter.
The Customer has the right to access and rectify and delete data concerning him. To exercise this right and obtain communication of information, the Customer can contact Mon Chou at contact@monchou.fi
 
  1. APPLICABLE LAW – DISPUTE RESOLUTION
These general conditions are governed exclusively by Finish law. Any dispute which cannot be settled amicably shall be submitted to the competent Court of Oulu exclusively.
